OVERVIEW

John Godsil has litigated and tried complex business, intellectual property, professional negligence, and real estate disputes for nearly thirty years.  His practice has included representing parties in partnership/shareholder litigation, real estate disputes, receiverships, breach of contract actions, business tort cases and trade secret misappropriation matters.

John obtained his juris doctor from UCLA School of Law and his undergraduate degree, summa cum laude, from California State University, Fullerton.  Prior to joining Rosen“RosenSaba, John was a partner at a prominent Southern California law firm where he practiced for over two decades.  In his free time, John enjoys hanging out with his family, running, traveling, and all things baseball.

PROFESSIONAL HIGHLIGHTS

Defeated a $32 million claim, confirmed the client’s $3 million ownership interest in a limited liability company, and secured a monetary of award of nearly $800,000 following a 10-day JAMS arbitration.  The award was subsequently confirmed by the Superior Court and affirmed in full on appeal, with the California Supreme Court ultimately denying the opposing parties’ attempt to seek further review.

Prevailed in a trial of fraud, elder abuse and real estate claims which resulted in the clients securing clear title to their multimillion property.

Obtained a comprehensive victory in a lengthy JAMS arbitration involving breach of contract and related claims on behalf of a real estate investor, which resulted in the forfeiture of the opposing party’s ownership interest (valued at $10 million) in a development, along with the dismissal of a multimillion cross-claim.

Tried and defeated claims of breach of fiduciary duty, breach of contract and declaratory relief brought by parties who sought to obtain control of the clients’ intellectual property rights and secure a large monetary award.

Obtained recovery of over $450,000 plus all attorneys’ fees incurred on behalf of a real estate investment firm that was defrauded in a commercial property transaction.

Successfully litigated and obtained recovery of over $1 million on behalf of an ice cream manufacturer in an action involving claims of breach of a distribution agreement and business torts.

Secured a judgment of dismissal following a motion for terminating sanctions in a fraud action brought against a real estate agent and broker.

Successful representation of a wine distributor in a series of lawsuits initiated in San Francisco and Napa that included claims of fraud, breach of contract, violation of the Lanham Act and unfair competition.

Successful defense of a private equity group, which, after acquiring a champagne house in Frace, was sued in California for breach of an alleged nationwide exclusive distribution agreement and related claims.
