Rosen Saba, LLP congratulates partner Elizabeth L. Bradley for her recent Ninth Circuit victory in which summary judgment was affirmed in favor of clients Hawthorne Airport, LLC and Advanced Air, LLC. The federal antitrust suit alleged a conspiracy to create a monopoly on fuel sales at the Hawthorne Airport. In an unpublished memorandum, the Court affirmed summary judgment on statute of limitations grounds, concluding plaintiffs’ 2020 suit was barred by the four-year statute of limitations since the antitrust claims accrued in 2009, and the continuing violation doctrine did not extend the statute.
